General Terms and Conditions of Use for Rendimento Visa TravelMoney Card

AGILLITAS SOLUÇÕES DE PAGAMENTOS LTDA., company responsible for issuing and managing prepaid cards, called Agillitas, headquartered at Av. Brigadeiro Faria Lima, 2092, 18º andar, São Paulo, Capital, enrolled in the Brazilian Registry of Corporate Taxpayers with CNPJ. No. 13.776.742/0001-55, accredited agent of MASTERCARD BRASIL SOLUÇÕES DE PAGAMENTO LTDA and VISA INTERNATIONAL SERVICE ASSOCIATION, in accordance with the Agreement of Affiliation and License for the Use of Trademark signed on 09/30/2002, hereby presents the General Terms and Conditions of Use of the Rendimento Travel Cards, as set forth below. By ordering the card, the customer agrees to all terms and conditions of this instrument.

This document may be modified at any time and its updated version will be available on the website informed on the back of your card.

  1. Definitions 

1.1. Card: Reloadable prepaid plastic card with the following contents: card number, serial number, expiration date and chip. Although the name of the card holder is not printed on the physical card, all information of the card holder is linked to its number, making it personal and non-transferable;

 1.2. Brand: Brand (*) company based in Brazil or abroad, owner of the brand, logo, franchise and the respective licensing for use in authorized merchants, for acceptance of cards as payment method;

1.3. Additional Card: card linked to a primary card, which accesses the same available balance, having, however, an individual statement and password. Additional card statements can be accessed by the primary card holder;

1.4. Merchant: individual or legal entity, suppliers of goods and/or services, affiliated with your card’s Brand, where you can make purchases with the card;

1.5. ATM: Automated teller machine where cash can be withdrawn with the card, affiliated with the Cirrus network, for Mastercard cards, or Plus network, for Visa cards;

1.6. Customer Service Center: call center, available 24 (twenty-four) hours a day, 7 (seven) days a week in Portuguese. For customer safety, all calls can be recorded;

1.7. Card Password: A 4 (four) digit numeric password printed on the document sent with the card, which can be changed on the website that is on the back of your card at any time by the Card holder, after confirmation of the counter-password. The Card holder is solely responsible for the card password;

1.8. Counter-password: security code with 4 (four) to 10 (ten) characters chosen at the time the card was ordered. The counter-password may be requested by the Customer Service Center or website for customer identification;

1.9. Electronic password: password to access the website for queries of the card balance and statement, also used to access the Banco Rendimento Mobile Application. This password may be requested for online purchases and on websites that require authentication. Registering or changing this password can be done on the website informed on the back of your card;

1.10. Distributor: company authorized by Rendimento to sell Rendimento Travel Cards. To see our distributors, visit the website www.rendimento.com.br;

1.11. Customer: person financially responsible for ordering the card, who may or may not be the Card holder;

1.12. Card Holder: person who will have the card linked to his/her name to make purchases and withdrawals during the trip;

1.13. Load and Reload: procedure whereby the Customer/Card Holder inserts credits in the card;

1.14. Statement: report containing information on loads, reloads, fees, withdrawals and transactions, available on the website;

1.15. Withdrawal: withdrawals of cash in Brazil and/or abroad, completed by use of the card and its password, in ATMs;

1.16. Transaction: transactions or deals completed with the card of the Customer/Card Holder involving acquisition/purchase of goods and/or services, and withdrawals;

1.17. Transaction Receipt: document issued by the Merchant, Distributor and/or Agillitas, indicating the transaction date and amount, informing the card number;

1.18. Website: exclusive online portal/website that the Customer/Card Holder will have access based on the terms and conditions of this Agreement, as well as access to information regarding available balance, transactions, transaction details and other card features, always using the electronic password;

1.19. Transaction Entry: Transactions represented by credits in cash, credits by TED – Electronic Transfers, cash withdrawals, transfer of funds by replacement, purchase payment transactions, loading, reloading or recharge receipts, reimbursement, credit as guarantee, debit entries, pre-book entries, card fee entries, among other operations;

1.20. Emergency Withdrawal: a cash remittance solution in case of card loss, to the country where the Card Holder is or will be, by the time the amount is received. The withdrawal can be carried out at local remittance agencies. To request an emergency withdrawal, the Card Holder must contact the Customer Service Center.

  1. How to order your card: 

2.1. To order the card, please contact the distributor of your choice and check out the purchase procedure. You must complete your registration (if you haven’t yet) and complete the currency exchange transaction in the amount that you want to load to the card, and this transaction is conditioned to the relevant currency exchange regulations;

2.2. The card will always be linked to the Card Holder, therefore, when ordering the card, you must inform the Card holder data, such as full name, CPF (SSN), address, phone number and counter-password;

2.3. The customer is responsible for the personal information provided at the time of ordering the card and is therefore responsible for data updates whenever necessary. To update this information, please contact the distributor where you ordered the card or the Customer Service Center. All required information and messages will be sent by the distributor, according to data registered in the system at order date;

2.4. The card is for the personal, exclusive and non-transferable use by the card holder/traveler;

2.5. When receiving the card, sign it on the back immediately, as your signature will be checked when completing a transaction. (see item 4, “A” Purchase payment);

2.6. The minimum and maximum card load and reload amounts are subject to the Internal Compliance Policy of Banco Rendimento and Agillitas, in compliance with Central Bank of Brazil rules;

2.7. After completing the transaction, it is necessary to sign the currency exchange receipt, a document required by the Central Bank of Brazil;

2.8. Each primary card allows issuing 4 (four) additional cards, which access the same balance;

2.9. Loads and reloads will be made directly by the distributor where the customer ordered the card. To check the time required to complete loads and reloads, the customer must contact directly the distributor who will inform the procedure for completing the process;

2.10. When ordering the card, the Card holder receives a card kit, consisting of a document letter, with the 4-digit card password, General Terms and Conditions of Use and a Quick Guide to Benefits and Services;

2.11. The Card holder is solely responsible for confidentiality of the password received with the card, as Banco Rendimento e a Agillitas are hereby exempted from any obligations arising from its misuse or disclosure to third parties. In this event, the communication procedure to Banco Rendimento described in item 6 (six) must be followed;

2.12. The expiration date is printed on the front of the card (MM/YY);

2.13. In order to comply with current legislation, when ordering your card from one of our distributors, your registration data may be accessed at any time by Banco Rendimento and Agillitas;

  1. How to reload or resell the remaining balance:

3.1. It is not mandatory to present the card to reload its balance. You just need the Card holder’s name or the 13-digit serial number located on the back of the card (lower right corner). Check the procedures with your distributor;

3.2. With this information in hand, contact the distributor where the card was ordered;

3.3. The process is similar to ordering the card, so the currency exchange receipt, related to the amount reloaded/unloaded on the card, must be signed as required by the Central Bank of Brazil;

3.4. The transaction of redeeming or adding funds to the card will be done only at the distributor where the card was ordered;

3.5. The remaining balance amount will be converted and delivered in reais according to current currency exchange regulations;

3.6. For more information about procedures for reloading or reselling the balance, please contact the distributor where the card was ordered.

  1. Card usage:

4.1. Transactions completed in a currency other than your card currency will have their amount converted following your card’s Brand conversion rates;

4.2. Some merchants now offer the possibility of selecting the currency for your card charges. At this time, you can choose the local currency or real. On most card readers this option is displayed on the screen and you can select the currency. At other locations, such as car rental companies, for example, the merchant delivers the purchase agreement and it states that the customer agrees to make the payment in reais. By signing the receipt or typing the password, having selected a payment in reais, you will be agreeing with the conversion rate set by the merchant, without any intervention of the issuer, distributor and your card’s Brand. In order to prevent additional conversion costs, we suggest that you do not choose payments in reais when using your Rendimento Travel Card.

4.3. Withdrawal transactions, plus withdrawal fees*, and purchases will be authorized only if there is balance available on the card, however, the card may have a negative balance due to transactions that can be confirmed by merchants when the card does not have enough balance, following the rules set by your card’s Brand. In these cases, the customer undertakes to settle the amount with the company where the card was ordered within 30 (thirty) days counted from the date Agillitas or Banco Rendimento contacted the customer. If the customer doesn’t settle the amount, Agillitas or Banco Rendimento may take appropriate measures to receive the card’s negative balance;

*The withdrawal fees consider Agillitas compensation and the compensation of the ATMs certified by the Brand.

4.4. As it is a card for electronic use exclusively, purchases made online, by phone or at merchants that use manual (non-electronic) card readers may be refused;

4.5. In case of online purchases, the issuer may request validation through a security device.

4.6. The card can be used for pre-booking and payments of hotel rooms or car rentals, but the balance will be blocked in the pre-booking or payment amount plus a 15% (fifteen percent) security rate on this amount for a period of 15 (fifteen) calendar days, until the merchant confirms the transaction. The merchant is responsible for the pre-booking and payment, as well as for its cancellation, if applicable, as only the merchant can enter debit transactions on the card. Check beforehand the payment and reservation conditions using the card directly with the merchant.

4.7. When used at gas stations abroad that allow self-service, the merchant will request a pre-authorization of 50.00 (in the card’s currency), thus, it is necessary to have this minimum balance amount for the transaction to be authorized. After confirmation by the gas station of the amount actually used, the exceeding amount will be automatically reversed in up to 7 (seven) calendar days;

4.8. In payment card transactions at bars or restaurants, check if the merchant will add the tip on the transaction amount. Never sign the receipt without properly filling out this optional charge. If you do not agree with the charge, cross out the Tip field or line. By signing the card receipt or entering the password, you will be agreeing with this extra amount that will be deducted directly from your card balance;

4.9. Use of the card may be restricted in some cruise ships due to their internal procedures. Remember to verify the card’s acceptance rules before traveling;

4.10. If the card password is entered incorrectly 3 (three) straight times, the card will be locked and will be unlocked automatically after 24 (twenty-four) hours. The electronic password is different from the password used for the card and will not be locked in the hypothesis provided herein, except if it is entered incorrectly, for 3 (three) times, when attempting to access the website. The electronic password will be unlocked only after customer contact with the Customer Service Center;

4.11. The customer can only change the password used to make purchases and withdrawals directly on the website that is on the back of his/her card or by the Banco Rendimento Mobile App for mobile phones and tablets available on the website www.rendimento.com.br, thus, the customer is unable to perform this procedure directly at the ATM;

4.12. Banco Rendimento offers an application for queries via mobile phones or tablets. Check the app general conditions on the website www.rendimento.com.br;

4.13. The card may have a negative balance due to later confirmation of transactions processed by merchants, following the rules set by your card’s Brand. In these cases, the Card holder undertakes to settle the amount with the company where the card was ordered within 30 (thirty) days counted from the date the card issuer contacted the customer. If the customer doesn’t settle the amount, the card issuer may take appropriate measures to receive the card’s negative balance. The Card holder authorizes balance transfers among cards linked to his/her CPF (SSN) to settle negative balances on other cards.

  1. How to check the card balance and statement:

5.1. For information regarding the card’s balance, statement, locking and unlocking the card, just access the website on the back of the card. If you prefer, use the Banco Rendimento Mobile App for mobile phones and tablets available at www.rendimento.com.br or call the Customer Service Center directly. The phone numbers are described on the back of the card and in item 11.8 of this term;

  1. How to proceed in case of Loss, Misplacement, Robbery or Theft:

6.1. In case of card loss, misplacement, robbery or theft, contact immediately the Customer Service Center to block your card. Until the card is blocked, all processed transactions are the card holder’s responsibility. If you prefer, you can block the card through the Banco Rendimento Mobile App for mobile phones and tablets available at the website www.rendimento.com.br or the website that is on the back of your card;

6.2. Remember to keep the password separate from the card to prevent its misuse;

6.3. If the card is lost abroad, card replacement is conducted by Agillitas through an international carrier, if it is in Brazil, it will be done by the distributor where the card was ordered;

6.4. The delivery time outside Brazil will depend on the delivery location;

6.5. The first replacement abroad will be free, for the second and other replacements, a replacement fee will be charged. Check out all applicable card fees in the Bank Fees section of the website www.rendimento.com.br;

6.6. The card will be delivered at the address informed by the customer or Card holder. If the customer or Card holder changes the address, after the process of sending the replacement card has started, a replacement amount will be charged directly from the card balance, related to change of delivery address. If after 3 (three) attempts, there is no one available at the location to receive the card, the Card holder shall collect it at the informed carrier within 3 (three) days. If the card is not collected within this period, it will be charged directly from the balance available on the card, according to the amount informed in the Bank Fees section. 6.7. If the card reported as lost, misplaced, robbed or stolen is found, it cannot be used, unless the Customer Service Center confirms the possibility of its reactivation;

6.8. In specific situations, Banco Rendimento and Agillitas may provide the possibility of an emergency withdrawal. This withdrawal is subject to the availability of remittance agencies at the requested location and balance available on the card;

6.9. The maximum amount for emergency withdrawal may vary according to the remittance agency that will provide the amount;

6.10. After release of the emergency withdrawal, if the amount is not withdrawn, if the request is canceled or if the withdrawal location is changed, a fee will be charged which will be charged directly from the card’s balance.   1. Transaction Dispute:

7.1. The Card holder must contact the Customer Service Center, disputing a transaction deducted from their card no later than 30 (thirty) days from the transaction date and following the procedures provided by the Customer Service Center;

7.2. Agillitas will conduct an investigation with your card’s Brand, which will verify with the merchant where the disputed transaction occurred, and the merchant must, within approximately 60 (sixty) days, answer this request;

7.3. If the merchant confirms the error, the amount will be reverted to the card after the investigation is completed;

7.4. In case of dispute, the Card holder must obtain proof of cancellation/refund with the merchant;

7.5. In case of transactions by Internet, phone and/or electronic channels, the use of the password or the electronic signature characterizes agreement with the transaction;

7.6. In the event of dispute of any transactions, the Issuer may request the Card holder for information in writing regarding the transaction for analysis, as well as additional documentation if necessary;

7.7. If the merchant proves the transaction, the charged amount will remain. Upon completion of the investigation, the merchant will have a period of 45 (forty-five) days to send documentation proving the transaction;

7.8. This procedure and the required documentation follow the rules set by your card’s Brand;

7.9. To start the investigation, the transaction must have at least the minimum amount informed in the bank fee table. Check out all applicable card fees in the Bank Fees section of the website www.rendimento.com.br;

7.10. If the investigation has started and the merchant proves the authenticity of the transaction, the amount indicated in the bank fee table, related to the cost of the investigation, will be charged from the card balance at the end of the investigation. 7.11. Non-disputing any transactions contained in the statement within the time frame informed by the issuer, implies that these transactions are recognized.

  1. Card expiration date:

8.1. The card can only be used up to the expiration date informed on it;

8.2. To replace the expired card, contact the company where you ordered the card at least one month before it expires;

8.3. If the card is not replaced by the expiration date, the monthly amount indicated in the bank fee table will be charged until its replacement. Check out all applicable card fees in the Bank Fees section of the website www.rendimento.com.br.

  1. Inactive Cards

9.1. Your card will be considered inactive from 6 (six) months without any transaction;

9.2. The monthly fee will be charged directly from the balance available on the card, as amount indicated in the section Bank Fees, if it remains without any transactions for more than 6 (six) months and has a balance lower than the amount indicated in the Bank Fees section. 9.3. If there is not enough balance for charging the full fee amount, the amount charged will be the balance available on the card.

  1. Safety Measures:

10.1. Remember to keep the password separate from the card to prevent its misuse;

10.2. The card holder is responsible for:

10.3. As a safety measure, the card issuer may block the card without prior notice, if it notices transactions different than the card holder’s use profile;

10.4. The Card holder authorizes the Issuer to contact him/her by any means, including by phone, email and SMS, to send communications related to the card;

10.5. The Card holder declares that all information provided at the time the card was requested, as well as for unlocking/locking the card, are true;

10.6. The Card holder shall keep their account information up to date with their Distributor. The Issuer, in turn, whenever necessary, may request update of the card holder’s account data.

  1. General Provisions

11.1. There may be restrictions on accepting the card in countries where United States government authorities impose a political or economic embargo. It is the responsibility of the Customer or Card Holder to verify beforehand the card’s acceptance at the travel destination;

11.2. Ordering and using the card expresses the customer’s knowledge of the current regulation of the currency exchange market that regulates currency exchange transactions. Non-compliance may characterize currency exchange fraud, punishable under the terms of current legislation. Characterization of currency exchange fraud may imply tax fraud, and the cases detected by the Central Bank of Brazil can be communicated to other public agencies according to legislation in force;

11.3. All transactions processed using the card are subject to current legislation, regulations, ordinances and other standards established by the relevant agencies, and the customer must follow these rules during any transaction with the card;

11.4. The card can’t be used for transactions related to investments abroad, imports subject to Siscomex registration and other transactions that depend on previous registration with the Central Bank of Brazil;

11.5. Use of the card by the customer or Card holder, that does not comply with current legislation, regulations, ordinances and other standards established by the relevant agencies, will force the Bank to communicate evidence of irregularities to the competent authorities, in addition to instantly blocking the card; 

11.6. The distributor, Banco Rendimento and Agillitas are exempt from liability for any restrictions on the use of the card imposed by merchants or local regulations of the country where the purchase or withdrawal transactions are made, as well as the price, quality and quantity of the goods acquired with the card;

11.7. All fees applicable to Rendimento Travel Cards are available in the Bank Fees section of the website www.rendimento.com.br;

11.8. The distributor, Banco Rendimento and Agillitas are not responsible for the international roaming fees charged by the phone operator. For more information, contact your phone operator;

11.9. In order to validate the information of the Card holder or person ordering the card described in this document, he or she authorizes Agillitas to verify his/her account information with credit reporting agencies.
